The Program

How Mississippi Work and Save works

Mississippi Work and Save was enacted April 8, 2026 (HB 4073). It creates a voluntary, state-sponsored retirement savings program for employers that do not offer a retirement plan — with no employer mandate. Participating employers may offer eligible employees the voluntary choice to contribute to a payroll-deduction IRA. Implementation is expected to follow program development by the State Treasurer; no timeline has been announced.

With no mandate and no announced timeline, Mississippi employers are free to decide on their own schedule. If a retirement benefit makes sense for recruiting, retention, or owner tax planning, a 401(k), Safe Harbor, SEP, or SIMPLE plan can be established now — and employers with staff in mandate states can satisfy those requirements with the same plan.

Your Next Move

What Mississippi employers should do next

  1. Understand that Mississippi imposes no employer mandate — HB 4073 created a voluntary program, and there are no noncompliance penalties.

  2. Note the enactment date of April 8, 2026; program design is still being developed by the State Treasurer.

  3. Expect no registration requirement or deadline for employers — none exists today and none has been announced.

  4. Watch for State Treasurer announcements as the payroll-deduction IRA program takes shape.

  5. Evaluate a retirement benefit on business merits — recruiting, retention, and owner tax planning.

  6. If you employ workers in states that do mandate coverage, review those obligations separately.
