The Utah Retirement Plan Exchange was established by HB 250 (2026 General Session), enacted March 24, 2026. It creates a voluntary retirement plan exchange/marketplace — not an employer mandate. Per HB 250, the exchange platform itself must be operational and accepting applications from plan providers no later than November 2, 2026. No employer registration is required.

For Utah employers the practical question is not compliance but strategy: whether a retirement benefit helps you recruit and retain, and which plan type fits your workforce. A 401(k), Safe Harbor, SEP, or SIMPLE plan can be put in place on your own timeline — and if you also employ workers in mandate states, one plan can satisfy those requirements at the same time.
